Terms & Conditions
Documents required at time of application for swimming pool permit.
For Swimming Pools:
- Type, size and shape of pool. (i.e. 5.7m x 10.5m in-ground kidney shaped pool)
- Location of the proposed setbacks from rear & side lots lines (not just the minimum required).
- Fencing details and gate locations. (i.e. height of fence, wooden/chain link/size of links, gates to be self-closing/self-latching)
- Location and setbacks of unitary equipment.
- Location and extent of septic system (if applicable).
- Easements.
For Hot Tubs/Hydro Massage Pools:
- Size & shape of Hot Tub/Hydro Massage Pool. (i.e. 8m x 8m x 3m deep)
- Location of the proposed setbacks from rear and side lot lines.
- Location and extent of septic system (if applicable).
- Easements

- Note: It is the Owner/Applicant responsibility to obtain the approval of Burlington Hydro indicating that private hydro services on the property will not be affected by the swimming pool installation.
2.5.1 Zoning Regulations for outdoor swimming pools:
- On lots containing detached or duplex dwellings and on lots containing one dwelling unit of a semi-detached, triplex, fourplex or street townhouse:
- Swimming pools are not permitted in a required front or street side yard
- In-ground pools shall be set back 1.5m from a property line or street line, measured from the inside wall of the pool.
- On-ground, above ground and temporary pools shall be set back from a property line or street line 1.5m plus 30cm for each 30cm that the top of the pool wall is above the grade elevation at the property line, measured from the inside wall of the pool.
- On lots containing residential dwellings other than those identified in (a) above, in-ground, on-ground and above ground pools shall be set back 15m from a lot line or street lines, measured from the inside wall of the pool.
If your application requires altering the property either for protecting or for conserving the topsoil you may require a site alteration permit from the engineering department. Unitary Equipment
Which includes central air conditioning units, heat pumps and swimming pool filters, shall be subject to the following regulations:
- Setback from a side lot line: 60cm
- Setback from a rear lot line: 60cm
- Setback from a dwelling: 1.5m maximum from front wall
- Swimming pool equipment is not permitted in the front yard.
